Abstract
Georgia’s current water allocation policy is governed by the Georgia Water Quality Control Act (O.C.G.A. §12-5-31) and the rules set down by the Georgia Department of Natural Resources, Environmental Protection Division. Unlike many regulations regarding the use of water, such as water quality, water allocation is primarily a state responsibility with very limited federal involvement. The American Society of Civil Engineers has produced a Regulated Riparian Model Water Code (Dellapenna, 1997) to guide legislators in writing laws affecting riparian water rights.
While the two codes share many similarities, they also show a number of differences which become clearer when the two codes are held in a side-by-side comparison. By aligning the provisions of the two codes with each other, readers can better understand how the Georgia code is varies from the national model.
